This difference is evident in how the law is constructed, but it also drives comparative studies focused on legal harmonization, the consolidation of human rights, the strengthening of institutions, and the search for solutions to common challenges, such as integration processes or the application of norms in the field of public international law.
2025-09-01T00:00:00-07:00Copyright (c) 2025 SCIENTIFIC JOURNAL LEGALIS ET POLITICAhttps://publishing.fgu-edu.com/ojs/index.php/RLP/article/view/655New approaches to Social Control: Processes and methods based on the Prevention of organized crime2025-09-28T12:52:37-07:00Luisa Rojasluisa_rojasgonzalez@hotmail.comIrasema Vílchezirasema-vilchez@hotmail.comCristina Seijo Suárezcristinaseijoa@gmail.com
The purpose of this article is to analyze the topic related to new approaches to Social Control: processes and methods based on the prevention of organized crime. The classic discussions of academics have been surpassed to the same extent that new perspectives, approaches and categories are introduced, under the pressure of unprecedented social realities. The alteration of the quality of the criminal act, the inefficiency of state agencies in criminal matters, the generalization of the fear of violence, the perception of impunity, among other phenomena, have placed issues such as privatization, informalization, deregulation, among others, at the center. To achieve the objective, a traditional or narrative review was carried out that consisted of an exhaustive search and analysis of the literature on the topic, including both classic works and recent scientific articles, highlighting bibliometric research and systematic reviews as categories of documentary research, with its own explicit methods and whose current trend is, mainly, the online search or in academic databases present on 2.0 platforms, without excluding the possibility of analyzing printed documents not digitized to date, as is still done in some disciplines. of the social sciences. For this reason, not everything is written about this ancient figure, since they are decantations that the doctrine develops from the inductive examination of the different penal institutions, sometimes expanded and consolidated by comparative criminal law.
2025-09-01T00:00:00-07:00Copyright (c) 2025 SCIENTIFIC JOURNAL LEGALIS ET POLITICAhttps://publishing.fgu-edu.com/ojs/index.php/RLP/article/view/656Effects of U.S. immigration policy on the employment situation of migrant workers2025-09-28T12:57:08-07:00Karol Liseth Baltazar SoteloKarol.baltazar.784@unisabaneta.edu.cMelany Quintero Loaizamelany.quintero.190@unisabaneta.edu.coSara Gallego Ochoasara.gallego.199@unisabaneta.edu.coEdgar Augusto García Medinaedgar.garcia.docente@uinisabaneta.edu.co
This study analyzed the impact of the United States’ restrictive immigration policies on the working conditions and professional development of migrant workers, as well as their effects on businesses operating in the country. The main objective was to understand how these policies influence job stability, growth opportunities, and the inclusion of migrants in the labor market. A mixed methodology was used, combining quantitative analysis of official data and surveys with a qualitative approach based on semi-structured interviews with migrant workers. The findings show that restrictive immigration policies contribute to labor precariousness, as many migrants despite having experience and professional training in their countries of origin are forced to accept low-skilled and poorly paid jobs. This supports the labor market segmentation theory and highlights how structural barriers limit the potential of foreign human capital. Additionally, the shortage of migrant labor negatively affects productivity in key sectors of the U.S. economy, such as agriculture, construction, and services. Current immigration policies, which emphasize control over entry and residence, create conditions of vulnerability and exploitation. Migrants often face low wages, long working hours, and limited opportunities for professional advancement. These conditions not only undermine the well-being and aspirations of migrant workers but also impact businesses by increasing employee turnover and reducing operational efficiency. In response to these challenges, the study recommends strengthening labor protection policies and promoting the fair integration of migrants into the workforce. Recognizing and valuing the contribution of migrant labor is essential for both social equity and sustained economic development
2025-09-01T00:00:00-07:00Copyright (c) 2025 SCIENTIFIC JOURNAL LEGALIS ET POLITICAhttps://publishing.fgu-edu.com/ojs/index.php/RLP/article/view/657Stories of adaptation: The Colombian Migrant experience in the U.S.2025-09-28T13:11:08-07:00Alison Daniela Narváez Católicoalison.narvaez.063@unisabaneta.edu.coMaría José Foronda Cañasmaria.foronda.714@unisabaneta.edu.coMichelle Carolina Ortega Castromichelle.ortega.048@unisabaneta.edu.co
This article analyzes the distinctive characteristics of Colombian migration to the United States, covering a representative period that extends from the 80s to the present day. Through exhaustive documentary research. With the help of a thematic analysis of the surveys and testimonies collected through the research, it was possible to identify patterns and trends that reveal the physical and mental consequences of migrants. Attention is also paid to the different obstacles that migrants have had to overcome, such as language barriers, discrimination and homesickness. In addition, the article discusses strategies that migrant respondents have developed during their years of residence to cope with difficulties and how to build a sense of belonging in their new home.
